CARAVAN PARK RULES

These caravan park rules are made in accordance with Part 4 and Part 4A of the Residential Tenancies Act 1997 (“the Act”). These caravan park rules apply to any caravan park residents, Part 4A Site Tenants, Annual Holiday Site Holders and any other visitor or occupier of the caravan park (referred to in these caravan park rules as “occupants”). These caravan park rules form part of any agreement between Wynndean Holiday Resorts Pty Ltd the “Park” and any occupier or non-resident the “occupant”.

1 Occupants Use of the Site

1.1. The occupants must use the site only for the purpose agreed with the park owner; and

1.2. use the site, caravan park and facilities properly and ensure that their visitors do the same.

2 Occupants Must Not Use the Site for Illegal Purposes

2.1. The occupants must not use or permit the use of the site, the dwelling or the caravan park for any purpose that is illegal at common law or under an Act.

3 Occupants Duty to Pay Rent

3.1. The occupants must pay the site fees and any other charges (hire fees, gas, electricity, visitor fees) agreed to the park owner on the due dates and in agreed manner.

3.2. Occupants are required to pay rent in advance, unless otherwise agreed in writing by the park owner.

4 Quiet Enjoyment - Occupant's Duty

4.1. Occupants must not do anything in or near the site or caravan park or allow their visitors to the caravan park or site to do anything which interferes with the privacy and peace and quiet of other occupants of the caravan park or their proper use and enjoyment of the caravan park.

4.2. Occupants must not do anything in or near the site or caravan park or allow their visitors to the caravan park or site to do anything which interferes with the caravan park owner or the caravan park owner’s agents completing its duties as caravan park owner.

5 Occupants Must Keep Site Clean

5.1. The occupants must keep the site clean and tidy; and

5.2. maintain the site and caravan in a manner and condition that do not detract from the general standard of the caravan park as set by the park owner from time to time.

6 Occupants Must Not Erect Structures

6.1. Occupants must not erect any structure on the site or in the caravan park , including sheds, clotheslines or fixed storage boxes.

7 The Making and Abatement of Noise

7.1 The occupants must keep noise to a minimum at all times ensuring that there is no unnecessary noise that may disturb others.

7.2 Ensure that any approved building, construction or maintenance works only occur on normal business days, Monday to Friday, between the hours of 8:00am to 4.30pm outside of school holiday periods.

8 Vehicles

8.1 Occupants must observe the park speed limit of 5km/h for all vehicles including bicycles & e-scooters (walking pace).

8.2 Occupants must not ride bicycles or e-scooters in the park outside daylight hours.

8.3 Occupants must only park their vehicle in the place specified by the park.

8.4 Occupants must ensure that their vehicle is parked off designated roads & pathways.

8.5 Occupants must not bring, permit, allow or invite any vehicle exceeding 3 tonnes gross weight to enter the caravan park without the prior consent of the park owner.

8.6 Occupants must charge electric vehicles, including light electric vehicles such as e-bikes and e-scooters, only at the electric vehicle charging stations provided by the caravan park.

8.7 Occupants must not charge electric vehicles, including light electric vehicles, directly from the site, dwelling or park owned facilities i.e. from a wall socket plug.

10 Disposal of Refuse

10.1. Occupants must wrap garbage before placing it in the bins.

10.2. Occupants must not use the caravan park garbage disposal facilities for the disposal of anything other than normal household refuse.

10.3. Occupants may request Park collection of acceptable recyclable items including bikes, fridges & mattresses.

11 The Keeping of Pets

11.1. Pets are not permitted in the park.

12 The Playing of Games and Other Sporting Activities

12.1. Occupants must not play ball games in or around the amenities block or within close proximity of a dwelling.

12.2. Occupants must use playground equipment in the proper manner and in accordance with any rules specific to a particular apparatus.

12.3. Occupants must refrain from engaging in dangerous behaviour in the playground area, in or around amenities blocks, and in any other communal area.

13 The Use and Operation of Communal Facilities

13.1. Occupants must not smoke in the amenities block, any park owned building, or facilities.

13.2. Occupants must not play music or consume alcohol in amenities.

14 The Supervision of Children

14.1. Occupants must maintain sufficient supervision of their children, so as to ensure that their children do not cause a nuisance or inconvenience to other occupants, management or employees of the caravan park.

14.2. Occupants must ensure that all children are supervised by an adult when using the amenities block, playgrounds and park grounds.

14.3. All children under the age of 18 are not permitted to occupy a site without adult supervision.

15 Visitors

15.1 Occupants must ensure that their visitors register their presence at the caravan park office upon entering the park by advising the caravan park owner of the visitor's name and address and pay the visitors fees, as determined by the park, if required.

15.2 Occupants accept all responsibility for their visitors.

16 Fires

16.1 Occupants must not light any fire other than a commercially constructed and approved LPG Barbecue.

16.2 Occupants must comply with any fire restrictions and/or conditions.

17 General Conduct

17.1 Occupants must ensure that they and their visitors do not behave in a manner that could be:

17.1.1 offensive to other park occupants, the caravan park owner and/or the caravan park owner’s employees and stakeholders;

17.1.2 a poor example to the children in the park; or

17.1.3 injurious to the reputation of the caravan park.

17.2 Occupants must communicate with the caravan park owner and their employees in a

courteous manner and must not engage in any threatening, impolite or aggressive behaviour

towards the caravan park owner and their employees.

18 Movable Dwellings and Annexes

18.1. Occupants must not extend, alter, modify or attach any fixtures to any site or dwelling within the caravan park without first obtaining the park owner’s written consent.

18.2. All movable dwellings must be RMD’s Registered Movable Dwellings (caravans) as defined by the Act & be maintained with the requirements set out in the Residential Tenancies (Caravan Parks and Movable Dwellings Registration and Standards) Regulations 2024.

18.2.1. Maximum length of caravans is 7.62m/25’ long.

18.2.2. Maximum height is 2.2m high above chasis (overall height 2.7m to ground).

18.2.3. Age of proposed caravans must be new or less that 15 years of age & approved by the Office for age, length & site suitability.

18.3. Annexe installations must be approved by park owner.

18.3.1. Annexe installations must be performed in accordance with the Residential Tenancies (Caravan Parks & Movable Dwellings) Regulations 2024 & relevant Australian Standards

18.3.2. Annexes are maximum 2.74m/9’ wide at Wynndean to comply with CFA separation & access.

18.3.3. Annexe size & position must be approved by park owner.

18.4. Occupants must: -

18.4.1. Ensure that the Unregistrable Movable Dwelling (UMD), relocatable home, caravan and/or annex or other structure does not occupy more than two thirds of the total site area.

18.4.2. Ensure written work requests are applied for to the park owner 14 days in advance.

18.4.3. Ensure that written approval has been granted prior to any works commencing.

18.4.4. Ensure that the park owner has been notified in advance of coming onto the site.

18.4.5. Ensure any trades performing approved works have submitted a certificate of currency (public liability) to the office.

18.4.6. Ensure that all trades comply with relevant regulations and submit copies of certificates of compliance to the park owner.

18.4.7. Upon vacating the caravan park, remove Caravan, Annexe and any alterations made to the site using suitably qualified trades thus returning it to the state and condition as of the commencement date.

19 Sale of Dwellings on Site at the Park

19.1 An occupier who intends to sell or offers to sell or dispose of an UMD, relocatable home, caravan and/or annex or other structure on a Annual Site must notify the caravan park owner of that intention and

19.2 The seller must advise any potential purchaser that the land or site that the RMD, caravan and/or annex is placed upon and any rights or interest in the land or site is not included in any sale.

19.3 The RMD, caravan and/or annex or other structure must be removed from the park upon any sale occurring, unless: -

19.3.1 The RMD, or caravan and/or annex complies with the caravan park rules of the caravan park owner, complies the Residential Tenancies (Caravan Parks & Moveable Dwellings Registrations & Standards) Regulations (2024), complies with all applicable municipal regulations and complies with Building Code of Australia where applicable; and

19.3.2 The caravan park owner has consented in writing prior to the RMD or caravan and/or annex being sold on site.

19.3.3 The caravan, annexe or RMD’s age is less than 35 years.

19.4 Fees must be paid up to date prior to the sales process commencement.

19.5 The caravan, annexe &/or RMD must be independently valued which forms the maximum approved price that the unit can sell on-site for.

19.6 The seller may add contents. If contents price is over $1,000.00 in value an itemized list must be provided to the park owner as agent.

19.7 A copy of the receipt of sale must be provided to the park owner not exceeding the valuation/maximum approved price.

19.8 The erection or displaying of any signage or advertising including ‘’For Sale’’ signs or similar are not permitted to be displayed on any site unless with the written consent of the caravan park owner.

19.9 If the seller appoints the caravan park owner to act as its agent to sell the dwelling on behalf of the seller, the seller will pay the caravan park owner as set out in the schedule if applicable.

19.10 The seller is liable for any fees, charges or commissions owed under any written agreement with the caravan park upon the sale of the dwelling.

20 Security

20.1 All occupants are responsible for the security of their own possessions.

21 Works

21.1 All works must be approved by the Park Owner prior to new additions. Whilst measurements have been specified, the Park Owner may have alternate requirements due to compliance of CFA Guidelines and vegetation.

21.2 Prior to approved works commencing all trades must provide a current certificate of currency (public liability) to the park owner.

21.3 Air conditioners one per site and not exceed 1HP (2.5kw). New or replacement air conditioner installation location must be approved by the park owner.

21.4 Annexe Awnings must be compliant materials not exceeding 1.2m in length and width not exceeding 2.7m. Awnings for side entry annexe doors must not exceed 4m in length and width not exceeding 1.2m.

21.5 Flyovers must be constructed of commercially engineered & compliant materials. Flyovers must cover the caravan only and be attached to the caravan (and annexe) and therefore are considered part of the caravan (RMD). A compliance plate must be installed by the installer.

21.5.1 Flyover must be installed over caravan only. 150mm maximum eave on sides. 300mm on ends as per computations.

21.5.2 The maximum highest point from caravan roof to highest point of flyover is 350mm.

21.5.3 Flyover cannot be enclosed or have vertical panels installed.

21.5.4 Air conditioners on the roof of a caravan must be independently boxed in if exceeding 350mm.

21.6 Ensuites must be approved by park owner & connected to the park’s sewer main by a licensed and registered plumber. Compliance certificate & plans must be provided to the park owner. New external ensuites are not permitted in the Park.

21.7 Hot water units must be gas instantaneous. Hot water storage units are not permitted.

21.8 Electricity one circuit per site with maximum supply of 15 amps. All sites must be protected by an RCD. Electrical appliances eg TV’s, heaters must not be located, installed or used outside.

21.8.1 Do not use any electrical appliance in a manner to, or do anything else to cause any power head, services pillar or other electrical installation servicing the site to be overloaded.

21.8.2 Obtain, at the cost of the occupant, a Certificate of Electrical Safety in respect of the Dwelling if reasonably required to do so by Wynndean and provide Wynndean with a copy of the certificate upon request.

21.9 Gas Cylinders regulators & hoses must be maintained in good condition, in-date, secured by chain on a concrete paver & valves facing away from dwelling as per AS 5601.

21.10 Gas heaters & portable BBQ’s must be 3m clear around and above of all combustible materials and supervised by an adult at all times.

21.10.1 BBQ’s & Outdoor heating appliances must comply with current CFA guidelines, restrictions & requirements.

21.10.2 Personal BBQ’s cannot be used on days of Total Fire Bans. No solid fuel BBQ’s including webbers with beads or wood.

21.11 Decking must not be over 300mm in height and not exceed 1.2m wide and 2.7m long. Side entry annexes not exceed 1.2m wide and 4.0m long. Decking must be attached to the annexe & form part of the annexe. A-frame boxes must be constructed of timber allowing ventilation and not exceed 1.2m in length and must not be higher than 1.2m

21.12 Sheds are not permitted within the park.

21.13 Storage boxes must be plastic and movable and not exceed 1.2m in height. Must not inhibit CFA Regulations including access and separation.

21.14 Trellis & fences are not permitted in park unless previously approved.

21.15 Trucks are not permitted in the park including delivery trucks.

21.16 Artificial Grass can be rolled out Melbourne Cup weekend & must be stored on-site after the Easter School Holidays end, neatly and not inhibit CFA Regulations including

access and separation.

21.17 Temporary Awning, Gazebos, Sunshades & Umbrellas must be removed and stored inside when the dwelling is unoccupied. Structures should not be tied to trees. Structures should be erected at least 500mm away form roads and pathways to allow clear vehicle and pedestrian movement in the park.

21.18 Washing Machines the maximum size washing machine allowed is 2.5kg cold water top loader. Washing machines must be installed by a licensed plumber.

22 Wyndean Vegetation and Environment

22.1 Occupants are not permitted to trim or cut any vegetation within the park.

22.2 Occupants are not permitted to dig, remove or disturb soil &/gardens without prior written approval from the Park.

23 Smoking

23.1 Smoking is not permitted in areas that are deemed to affect others.

23.2 No smoking within 10m of playgrounds or park amenities.

24 Camping

24.1 Tents and swags are not permitted to be erected in park.

25 Poisons

25.1 Poisoning of any description is not permitted within the park.

26 Changes to these Rules

26.1 The caravan park owner may amend these rules or make new rules by giving occupants at least seven (14) days written notice of any proposed change to the rules in accordance with the Act.

27 The Act and other Policies of Caravan Park Owner

27.1 Any provisions of the Act as well as any other policies, rules, terms and conditions of the caravan park owner that are not included in these rules shall remain in full effect and be enforceable against any occupants.

28 Consent to Service

28.1 Any person that resides or visits the caravan park whether with the permission of the caravan park or not consents to the service of all notices, requests, demands or other communications to any party be given to or made upon the party in writing and may be given –

(a) by post to the party’s last known address

(b) by email with a printed or electronic copy of the email retained as proof of delivery, or

(c) by hand delivery

28.2 Posted notices will be taken to have been received 3 business days after posting unless proved otherwise.

28.3 A Notice delivered or email after 5.00 pm will be taken to have been received at 9.00 am on the next business day at the place where it is received.

28.4 For the purposes of section 8 of the Electronic Transactions (Victoria) Act 2000 the Owner and the Principal Occupant each consent to notices under this Agreement, related to this Agreement, pursuant to the Australian Consumer Law and Fair Trading Act 2012 (Vic), being served by email.

28.5 For the purposes of section 8 of the Electronic Transactions (Victoria) Act 2000 the Owner and the Principal Occupant each consent to any Victorian Civil and Administrative Tribunal Application relating to this Agreement or the Dwelling being served by email.

28.6 The caravan park may require that an address for service of documents is required upon entry to the caravan park.

29 Flood, Fire and Emergency Evacuation Directions

29.1 Occupants, guests and visitors must immediately comply with any direction by the caravan park or any Government Authority, including but not limited to the Victoria State Emergency Service (SES), Country Fire Authority (CFA) and Victoria Police, to evacuate their site and the caravan park in the event of a flood, fire, bushfire or any other emergency.

29.2 Occupants must not return to their site or the caravan park without the express permission of the caravan park following a flood, fire, bushfire or other emergency.
